User Responsibilities

User-Uploaded Content

You may upload your own photos and designs to use in the Service. You are solely responsible for the content you upload and for ensuring that you have the necessary rights, licenses, and permissions for these materials. You also agree not to upload any content that infringes on any copyright, trademark, or other intellectual property rights.

Third-Party Services

We allow access to Pixabay.com's free stock photo collection. The use of Pixabay's services is subject to their own Terms of Service.

Pre-Design Templates

We provide pre-designed templates for users to customize. You retain all rights to designs and other content you create using these templates within the Service.

Licenses

User License

By using our Service, you grant MyEcoverMaker a non-exclusive, royalty-free license to use, display, and store your designs for the purpose of providing the Service.

Template License

You are granted a non-exclusive, royalty-free license to use, modify, and create derivative works from the templates provided within the Service. You retain all rights to designs you create based on these templates.

Limitation of Liability

We will not be responsible for any damage or loss caused by the use of our Service, including but not limited to any loss or damage due to unauthorized use of our platform or your data.

Refund and Cancellation Policy

Automatic Renewal

All subscriptions to MyEcoverMaker are set to automatically renew on their anniversary date each month. Your account will be charged on this date to continue the Service for the following month.

Cancellation

You have the option to cancel your subscription at any time. To cancel, you must do so before the renewal date to prevent your account from being charged for the next month. If you cancel prior to the renewal date, you will retain access to the Service for the remainder of the paid month.

No Refunds

As MyEcoverMaker offers a self-managed subscription service, users are responsible for managing and canceling their own subscriptions. Because of this, we do not offer refunds for any subscriptions, regardless of usage. Please make sure to cancel your subscription before the renewal date if you no longer wish to use the Service.

Data Retention and Downgrading

Downgrading to Free Account

Upon cancellation of a paid subscription, your account will be automatically downgraded to a free account.

Data Retention After Cancellation

After your account has been downgraded to a free account, your work will be saved on our servers for a period of 3 months from the day of the downgrade. After this 3-month period, your work may be deleted from our servers unless you upgrade to a paid subscription.

Continuity of Data Storage

To ensure continuous data storage beyond the initial 3-month period, you must have at least one paid subscription in place every 3 months. Failure to maintain at least one paid subscription every 3 months may result in the permanent deletion of your work from our servers.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page and your continued use of the Service after changes have been posted will constitute your agreement to the new Terms.

General Terms

Restrictions On Use

You may use this site for purposes expressly permitted by this site. You may not use this site for any other purpose, including any commercial purpose, without MyEcoverMaker's express prior written consent. For example, you may not (and may not authorize any other party to) (i) co-brand this site, or (ii) frame this site, or (iii) hyper-link to this site, without the express prior written permission of an authorized representative of MyEcoverMaker. For purposes of these Terms of Use, "co-branding" means to display a name, logo, trademark, or other means of attribution or identification of any party in such a manner as is reasonably likely to give a user the impression that such other party has the right to display, publish, or distribute this site or content accessible within this site. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited. If you become involved in any violation of system security, MyEcoverMaker reserves the right to release your details to system administrators at other sites in order to assist them in resolving security incidents.

MyEcoverMaker reserves the right to investigate suspected violations of these Terms of Use.

MyEcoverMaker reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing MyEcoverMaker to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms of Use.

BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS COMPANY FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY COMPANY DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER [COMPANY] OR LAW ENFORCEMENT AUTHORITIES.

Miscellaneous

These Terms of Use will be governed and interpreted pursuant to the laws of Cyprus notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Cyprusin connection with any dispute between you and MyEcoverMaker arising out of these Terms of Use or pertaining to the subject matter hereof. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use or pertaining to the subject matter of these Terms of Use will be in the courts in Nicosia, Cyprus. If any part of these Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement among the parties relating to this subject matter. Notwithstanding the foregoing, any additional terms and conditions on this site will govern the items to which they pertain. MyEcoverMaker may revise these Terms of Use at any time by updating this posting
